  1. Introduction and Parties

These Terms and Conditions (“Terms”) govern your use of the website www.almazine.org (“Website”), operated by almaZINE and Leah Brickhouse (“We”, “Us”, “Our”), registered in Norway, located at Prinsens Gate 18, 4008 Stavanger, Norway. Our contact email is contact@almazine.org and phone number is +47 411 24 420.

These Terms apply to all visitors, users, and others who access or use the Website, including the purchase of goods such as zines (“Goods”) and the use or purchase of services such as consultancy, workshops, or access to content (“Services”).

By accessing or using the Website, or purchasing Goods or Services, you (“You”, “User”, “Customer”) agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Website or purchase Goods/Services.  

Consumer purchases made through this Website are primarily regulated by Norwegian laws including the Consumer Purchase Act (Forbrukerkjøpsloven), the Right of Withdrawal Act (Angrerettloven), the Marketing Control Act (Markedsføringsloven), the Personal Data Act (Personopplysningsloven), the E-commerce Act (Ehandelsloven), and the Payment Services Act (Finansavtaleloven). These laws provide consumers with non-waivable rights. Where these Terms might seem to provide lesser rights, the mandatory provisions of Norwegian law prevail.

2. Use of Website

You agree to use the Website only for lawful purposes and in a way that does not infringe the rights of, restrict or inhibit anyone else’s use and enjoyment of the Website.  

Prohibited behavior includes harassing or causing distress or inconvenience to any other user, transmitting obscene or offensive content, or disrupting the normal flow of dialogue within our Website.  

Content provided on the Website, including blog posts, podcast episodes, and zine previews, is for informational and educational purposes only. It does not constitute professional medical, legal, financial, or psychological advice. Always seek advice from qualified professionals for specific concerns.

3. Intellectual Property

All content included on the Website, such as text, graphics, logos, images, audio clips (including podcasts), digital downloads (including zines), data compilations, and software, is the property of almaZINE and Leah Brickhous or its content suppliers and protected by Norwegian and international copyright laws.

You may not systematically extract and/or re-utilise parts of the contents of the Website without Our express written consent. Specifically, you may not utilise any data mining, robots, or similar data gathering and extraction tools to extract (whether once or many times) for re-utilisation any substantial parts of the contents of this Website, without Our express written consent.

4. Purchasing Goods (e.g., Zines)

An agreement is binding once you have placed your order and received an order confirmation from us. Ensure you provide a correct email address for confirmation.

Payment can be made using the methods specified on the Website using Visa, Mastercard via Stripe.

For physical goods, payment may be reserved upon order and charged when the Goods are shipped.

For digital goods, payment is typically charged immediately upon order completion, before access/download is granted. See Section 5 regarding the Right of Withdrawal for digital content.

4.3 Delivery (Applicable to Physical Goods):

Delivery occurs when you, or your representative, take possession of the Goods.

We will ship Goods to the address you provide during checkout. Stated delivery times are estimates. Unless otherwise agreed, delivery will occur without undue delay and no later than 30 days after the order.

Shipping costs are specified during the checkout process.

The risk for the Goods passes to you upon delivery. If the goods are damaged during transport, please notify the carrier and Us as soon as possible.

4.4 Right of Withdrawal (Angrerett) for Goods:

As a consumer within the EU/EEA (including Norway), you have a statutory right to withdraw from the purchase contract within 14 days without giving any reason.  

The withdrawal period expires 14 days after the day you (or a third party designated by you, other than the carrier) receive physical possession of the Goods (or the last Good, if the order involves multiple items delivered separately).  

To exercise the right of withdrawal, you must inform us of your decision by an unequivocal statement (e.g., a letter sent by post or email to contact@almazine.org). You may use the standard withdrawal form (angreskjema) provided by the Norwegian authorities (available here), but it is not obligatory.  

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.  

Effects of withdrawal: If you withdraw, we will reimburse all payments received from you, including the costs of delivery (except for supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the Goods back or you have supplied evidence of having sent back the Goods, whichever is the earliest.  

You shall send back the Goods or hand them over to us at the address stated in email with contact@almazine.org without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the Goods before the period of 14 days has expired.  

You will have to bear the direct cost of returning the Goods.  

You are only liable for any diminished value of the Goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the Goods.  

Exceptions to the Right of Withdrawal: The right of withdrawal does not apply to:

Goods made to your specifications or clearly personalized.  

Sealed Goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery (e.g., certain types of intimate products if applicable).

Sealed audio or sealed video recordings or sealed computer software which were unsealed after delivery.  

Digital content which is not supplied on a physical medium if the performance has begun with your prior express consent and your acknowledgment that you thereby lose your right of withdrawal.  

4.5 Lack of Conformity (Reklamasjon) / Faulty Goods:

If there is a defect (mangel) in the Goods, you have rights under the Norwegian Consumer Purchase Act (Forbrukerkjøpsloven). A defect exists if the Goods do not conform to what was agreed or what you could reasonably expect based on the product information and circumstances.

You must notify us of the defect within a reasonable time after you discovered or should have discovered it. A notification within two (2) months of discovery is always considered within reasonable time. The absolute deadline for complaints is two (2) years after you received the Goods. For Goods that are intended to last significantly longer than two years through normal use, the deadline is five (5) years. In case of a defect, you may primarily demand:

Correction (repair) or re-delivery (replacement) free of charge.

If correction or re-delivery is not possible, imposes unreasonable costs on us, or is not done within a reasonable time (we generally have two attempts to rectify the same defect), you may demand:

A proportionate price reduction.

Cancellation (heving) of the purchase if the defect is not insignificant.

You may also be entitled to compensation for documented financial loss resulting from the defect under certain conditions. Complaints should be made in writing (e.g., email to contact@almazine.org).

5. Purchasing or Using Services (e.g., Consulting, Workshops)

5.1. Service Description and Pricing

Descriptions of Services offered will be provided on the Website.

Pricing for Services, including VAT (MVA) and any recurring fees, will be clearly stated before you commit to purchase or subscribe.

5.2. Booking/Access and Payment:

Procedures for booking (e.g., workshops, consulting) or accessing Services (e.g., subscriber content) will be detailed on the relevant page.

Payment terms are as specified during the purchase/subscription process.

5.3. Cancellation (Specific Service Terms):

If cancellation of a booked service (such as a consultation, workshop, or other agreed meeting) occurs after the expiry of the free cancellation period stated in our terms, a cancellation fee will be invoiced.

In case of non-attendance at the agreed time without valid cancellation according to the terms (“no-show”), the full amount for the ordered service will be invoiced.

The customer is responsible for ensuring that cancellation is made within the applicable deadlines.

5.4. Right of Withdrawal (Angrerett) for Services:

The 14-day right of withdrawal also applies to service contracts, starting from the day the contract is concluded.

If you request the service to begin before the withdrawal period ends, you must pay us an amount proportional to what has been supplied until you informed us of your withdrawal, compared to the full coverage of the contract.

The right of withdrawal is lost if the service has been fully performed, provided that performance began with your express prior consent and acknowledgment that you would lose your right of withdrawal once the contract had been fully performed by us.

Use the process described in Section 4.4 to exercise this right.

5.5. Lack of Conformity (Reklamasjon) / Faulty Services:

If our Services are not performed as agreed or with the required professional skill, you have rights similar to those for Goods, adapted for services (e.g., demanding remedy, price reduction, cancellation if the failure is significant), according to relevant Norwegian consumer law (primarily the Håndverkertjenesteloven may apply by analogy or general contract principles). Complaints must be made within a reasonable time.

6. Disclaimers

The information, content, and materials on the Website (including podcasts and zines) are provided “as is”. We make no warranties, expressed or implied, and hereby disclaim and negate all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.  

We do not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on the Website or otherwise relating to such materials or on any sites linked to this site. Content discussing health, mental health, social issues, or similar topics is for general information and awareness only and is NOT a substitute for professional advice.  

7. Limitation of Liability

To the fullest extent permitted by Norwegian law, almaZINE and Leah Brickhouse shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the service; (b) any conduct or content of any third party on the service; (c) any content obtained from the service; and (d) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.  

This does not affect our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation, nor any other liability which cannot be excluded or limited under applicable Norwegian law, especially consumer protection laws.

8. Privacy Policy

Your use of the Website is also governed by our Privacy Policy, which can be found here: https://almazine.org/privacy-policy/. The Privacy Policy explains how we collect, use, and protect your personal data in compliance with the GDPR and Norwegian data protection law (Personopplysningsloven). 

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide reasonable notice prior to any new terms taking effect (e.g., via email or a notice on the Website). What constitutes a material change will be determined at our sole discretion.  

By continuing to access or use our Website or Services after any revisions become effective, you agree to be bound by the revised terms.  

10. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of Norway, without regard to its conflict of law provisions.

We encourage you to contact us first at contact@almazine.org to seek a resolution for any disputes.

If a dispute cannot be resolved amicably, you can contact the Norwegian Consumer Council (Forbrukerrådet) for mediation (www.forbrukerradet.no).

Note regarding the EU ODR Platform: The European Commission’s platform for online dispute resolution (ODR) is being discontinued. New complaints cannot be filed after March 20, 2025, and the platform will close on July 20, 2025. For disputes, please use the national channels mentioned above.

Any disputes that cannot be resolved through mediation may be brought before the ordinary courts of Norway, with Stavanger District Court (Stavanger tingrett) as the agreed legal venue, unless otherwise stipulated by mandatory law.
